The petitioner claims promotion to the post of Forester as he is working as Forest Guard since 2010. It is his case that he can be considered for promotion to the post of Forester but the respondents are not considering his case. 3. Promotion is not a fundamental right. The right which the petitioner has is to be considered for promotion. There is nothing in the petition to suggest as to whether the respondents have initiated process for promoting anyone to the post of Forester or not. It is up to the employer to consider when they will initiate a process, as per their needs. If any person junior to the petitioner is considered for promotion and the petitioner is left out the petitioner definitely has a right. In this case there is nothing to suggests as to whether the 2025:JHHC:26535 2 respondents have taken any steps to initiate the promotion process to the post of Forester. 4. Thus, no positive order in favour of the petitioner can be passed. However, if the respondents initiate process for promoting the employees to the post of Forester and if the petitioner comes within the zone of consideration, his case should be considered with the other similarly situated eligible persons. 5.
