P.P. …...... 03/ 29.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 356/379 of IPC. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. This is a case of chain snatching from the train. 5. The person who snatched the chain was caught later on. He disclosed the name of this petitioner as one of his associates. 6. Except the confessional statement there is no other material. Further the petitioner does not have any criminal antecedent. So far as impugned order is concerned, I find that it has been noted in the impugned order that notice under Section 41(A) of Cr.P.C. was issued to the petitioner. 7. Since, notice under Section 41(A) of Cr.P.C. has been issued, it is presumed that police does not warrant to arrest the petitioner. Thus, I feel that this is a fit case for grant of anticipatory bail of the petitioner. 8. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Railway Judicial Magistrate 1st Class, Sahibganj, in connection with Barharwa Rail P.S. Case No.42 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 9. I direct the petitioner to appear before the Investigating Officer and cooperate with the investigation and thereafter, appear before the Court concerned with an undertaking that he will appear before the Investigating Officer once in every 15 days till completion of investigation and will also cooperate not only with the investigation, but in the trial also, if at all chargesheet is submitted against him.
