ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitionerfor granting of pre-arrest bail in connection with complaint bearing D.O.Lr.No.434/Dy. Speaker. APLA/Camp office/2025 dated 10.06.2025.
2. Heard Sri Ponnavolu Sudhakar Reddy, learned Senior Counsel representing Sri Bugulu Sreeteja, learned counsel for the petitioner and the learned Public Prosecutor for the respondent. This Court, on last occasion observed that an application for grant of pre-arrest bail is maintainable, even though there is no FIR registered against the person or suspect, as per the judgments of the Hon’ble Apex Court in Shri Gurbaksh Singh Sibbia and others vs. State of Punjab^ and Sushila Aggarwal and others vs. State (NOT of Delhi) and others^

I In the course of arguments, learned Public Prosecutor submits that they have not registered any case based on the letter addressed by K.Raghu Ramakrishna Raju, Member of Legislative Assembly, Undi Constituency, former member of Parliament and they are also not going to register a case against the petitioner based on the letter addressed by K.Raghu Ramakrishna Raju, as the Police have already registered a case based on complaintmade

4 Dr. YLR^J CrI.P.N0.5884 of 2025 Dated 07.08.2025 by one Kambampati Sirisha, which is registered as a case in Crime No.376 of 2025 of Tadepalli Police Station, based on the same alleged incident. The learned Public Prosecutor has brought to the notice of this Court the order passed by a learned Single Judge of this Court in Criminal Petition No.9662 of 2024 in the similar circumstances, dismissing the petition filed for grant of pre arrest bail, as the petitioner therein was not arrayed as accused in the crime. In view of the above, the apprehension of the petitioner is only
5. misplaced and not reasonable to believe that the Police are going to arrest him, and this Court deems that this case is not a fit case to grant pre-arrest bail to the petitioner.
6. Accordingly, the criminal petition is dismissed. As a sequel. Miscellaneous petitions, if any pending, shall stand closed.
