HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 12383 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. 1. Heard learned counsel for petitioner and learned state counsel for opposite parties. 2. Petition has been filed challenging order dated 26th October 2023 whereby adverse entry was recorded in petitioner's A.C.R. Further prayer for a direction to concerned authority to consider petitioner's case for promotion on the post of Deputy Commission & Deputy Registrar. 3. At the very outset, learned counsel for the petitioner submits that since petitioner's representation against impugned order dated 26th October 2023 was not considered and decided within the time frame specified in terms of Rule 5 of Uttar Pradesh Government Servants (Disposal of Representation Reports and Allied Matters) Rules 1995, the same cannot be considered for the purposes of promotion of petitioner and therefore his case for promotion may be considered ignoring the said order. 4. Learned state counsel has refuted submissions advanced by learned counsel for petitioner with submission that even as per averment of learned counsel for petitioner, the present petition has been filed only on apprehension that his case would not be considered for promotion. It is further submitted that said apprehension is clearly misplaced. 5. Considering submissions advanced by learned counsel for parties and perusal of material on record, particularly with regard to submissions Versus Counsel for Petitioner(s) : Sharad Pathak, Piyush Pathak Counsel for Respondent(s) : C.S.C.
