HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9944 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned AGA for the State and perused the record. 2. The applicant seeks enlargement on bail in FIR No.185 of 2025, under Sections 305, 324(4), 331(4), 317(2), 111(2(b) BNS, P.S. Malipur, District- Ambedkar Nagar. 3. In terms of the FIR, it has been alleged that on 28.08.2025, some unknown persons have committed a theft, in which, the jewellery etc and a laptop was stolen. No one was named in the FIR. Subsequently, based upon the recovery of some jewellery, applicant was named in the offence in question. 4. Contention of learned counsel for the applicant is that the recovery was not made in the presence of independence witnesses. He further submits that the offence under Section 305 IPC alleged against the applicant is punishable upto seven years and no material exists to implicate the applicant for the offence punishable under Section 111(2)(b) of the BNS,
2023. 5. Learned AGA has opposed the bail application. 6. From the bare perusal of the record, prima facie, the allegation to implicate the applicant under Section 111(2)(b) is apparently missing coupled with the fact that the applicant is in jail since 14.09.2025 having criminal history, he is entitled to be enlarged on bail. In view thereof, the Versus Counsel for Applicant(s) : Nijam Ahamad Counsel for Opposite Party(s) : G.A. Babloo Lona .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
application is allowed. 7.
