It is clear from the office note dated 02.05.2025, the notice was validly served upon the opposite party, but he has not appeared through his counsel. 2. Heard learned counsel for the petitioner. 3. Instant transfer petition has been preferred for transfer of Original Suit No. 376 of 2024 from the Court of learned Principal Judge, Family Court, Ranchi to the Court of learned Principal Judge, Family Court, Simdega. It is further submitted that petitioner’s husband i.e. opposite party has filed Original Suit No. 376 of 2024 under Section 9 of Hindu Marriage Act, 1955. 4. Learned counsel for the petitioner has submitted that the marriage of the petitioner with the opposite party was solemnized on 18.02.2017 according to Hindu Rites and Customs with 5 lakh cash and gold worth Rs.5,000,00/- as dowry at the time of marriage in presence of their family members, relatives and friends of both the parties. Out of their wedlock they were blessed with one child 2025:JHHC:18759 namely, Sathwik Shashwak. After sometime of marriage, she was being subjected to cruelty on the pretext of demand of dowry due to which she started living with her child at her parental home. It is further submitted that petitioner is residing with her old and ailing parents and petitioner is unable to attend the Court at Ranchi which is about 150 KM from Simdega. Petitioner has filed a case under Section 498-A against O.P. as well as a case for maintenance allowance vide Maintenance Case No. 07 of 2022 in Simdega, therefore, prayed for transfer of this Original Suit No. 376 of 2024 from the Court of Principal Judge, Family Court, Ranchi to the Court of Principal Judge, Family Court, Simdega. 5. Considering the contentions raised on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer for the petitioner. 6. Accordingly, the proceeding of Original Suit No. 376 of 2024, pending before the Court of learned Principal Judge, Family Court, Ranchi is hereby, transferred to the learned Court of Principal Judge, Family Court, Simdega. 7.
