Order This Writ Petition has been filed for issuance of a mandamus to forbear the respondents 2 and 3 from surveying and demarcating or changing the structure of the property (morefully described in the prayer to this Writ Petition) until the disposal of the suit in O.S.No.89 of 2023 on the file of the Learned District Munsif Omalur Salem District. 2. 3. The petitioner’s claim is that he is the owner of the property, (morefully described in the prayer to this Writ Petition). The apprehension of the petitioner, in this Writ Petition is that, without hearing his objection, the respondents 4 to 7 are now attempting to survey and demarcate the boundaries of his property, with the assistance of respondent Nos.2 and 3, which, according to the petitioner will be detrimental to his interest. 4. The learned Special Government Pleader for respondent Nos.2 and 3 would submit that only after hearing the objection of the petitioner, survey and demarcation of boundaries will be done on the request made by the private respondents, viz., respondent Nos.4 to 7. 5.
In view of the same, the apprehension of the petitioner, as raised, in this Writ Petition would no longer survive. 6. Accordingly, this Writ Petition is disposed of by directing the official respondents to intimate the petitioner and receive objection from him before surveying and demarcating the boundaries pertaining to the property 3/5 https://www.mhc.tn.gov.in/judis
