The instant Writ Petition is filed questioning the notice dated 09.06.2025 issued by the 5*'^ respondent directing the petitioner to appear before him on 17.06.2025 for joint survey that would be conducted by the Revenue Officials, to remove the alleged encroachments in the subject land, classified as "Kalibata”. 3. Learned counsel appearing on behalf of the petitioner would submit that the impugned proceedings dated 19.05.2025 and 09.06.2025 are vague does not contain the extent, length and breadth, in whichthe petitioner alleged to have occupied the land. It is further submitted that pursuant to the impugned notice dated 09.06.2025 the respondents have resorted to remove the structures over the subject land. 4. Learned Assistant Government Pleader for the Revenue would submit that the land occupied by the petitioner is classified as Kalibata'm the records and the villagers have been using it for their ingress and egressto the agricultural fields and the villagers have no other alternative way to reach their agricultural lands, unless the encroachment is removed. revenue 5. Having regard to the submissions made, this Court is deems it fit to dispose of the Writ Petition, directing the respondents to follow due procedure contemplated under law, if the possession of the petitioner over the subject land is unauthorized. Till such time, the respondents are directed not to demolish the structure over the subject land or dispossess the petitioner from the subject land. It is needless to observe that the respondents shall provide opportunity of hearing to the petitioner and follow due process of law. as an 6.
