The petition coming on for-hearing, upon perusing the Petition and the rl_`\ grounds filed in support there-6'+F' and upon hearing the arguments of Sri K.Pridhvi Raju, Advocate for the Petitioner and of Public Prosecutor for Respondent, the Court made the`following I - \_3',1l i I I.~_l 4J`- HON'BLE SRI JUSTICE KI SREENIVASA REDDY Criminal Petition NoI5893 of 2025 Order: The Criminal Petition, under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.312 of 2019 of DevarapaIIi Police Station, Visakhapatnam District. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that, on o8.09.2019 at 07.30 hours, on credible information about illegal transportation of ganja, ASI No.1197, Devarapalli Police Station, along with his staff and mediators, proceeded to Sri Rampuram Junction, Devarapalli MandaI, and while conducting raid found Al to A5 illegally transporting 36 Kgs of ganja in Auto bearing No.AP 31 TG 4160. The accused persons were arrested and the contraband, along with Auto, was seized. 4. Learned counsel for the petitioner submits that the petitioner was shown as Accused No.1 basing on the confessional statement of co-accused. Learned Assistant public prosecutor submits that major portllOn of the investigation has been completed. 6. Heard. perusedtherecord. 7. Basing on the confessional statement of co-accused, a case has been registered against the petitioner here,-n and the petitioner herein was not apprehended at the scene of offence. The petitioner has been in J-udjCial remand on 27.05.2025. ConsiderI|ng the facts and circumstances of the case, this court is inclined to release the Petitioner On bail. 8. Accordingly, the criminal petition is allowed. The petitioner/ Accused No.1 shall be released on bail on executing a personal bond for Rs.10,OOO/-(Rupees Ten Thousand only) with two suretI-eS for the like sum to the satisfaction of the learned I Additional District & Sessions Judge-Gum-special Judge for trial of offences under the NDPS Act, Visakhapatnam. The petitioner shall appear before the Station House Officer concerned on every sunday between 10.00 AM and 1.00 PM till filing of the charge sheet. SD/-K.
