05/ 11.08.2025 Heard learned counsel appearing for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Jharia P.S. Case No. 241 of 2023, registered for the alleged offence under Section 379 of the Indian Penal Code, pending in the Court of learned Additional Chief Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioner submits that the allegations are made of stealing three motorcycles and out of which, one motorcycle has been recovered from the possession of one Mukesh Kumar Rawani and he has taken the name of this petitioner in another case. He submits that two other FIRs have also been registered and the petitioner has been named in both the cases, pursuant to the name taken by said Mukesh Kumar Rawani. He further submits that the petitioner is having no criminal antecedent prior to lodging of these case and disclosure to that effect has been made in para-17 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement of one Mukesh Kumar Rawani.

Considering that the petitioner was having no criminal antecedent and prior to lodging of two cases disclosure to that effect has been made in para-17 of the petition and the name of the petitioner

has come only on the basis of confessional statement of one Mukesh Kumar Rawani, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Dhanbad, in connection with Jharia P.S. Case No. 241 of 2023, subject to conditions as laid down under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.
