Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application u/s 528 BNSS has been filed against the order dated 26.09.2024, passed by Additional Principal Judge, Family Court, Court No.1, Azamgarh in Case No. 29 of 2017 (Shabana v. Yasir) under Section 128 CrPC, (Enforcement of Order) as well as recovery warrant issued on 09.10.2024 by the Collector/ District Magistrate, Azamgarh to the tune of Rs.5,76,000/-. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and that the applicant may be permitted to pay/ deposit the arrears of maintenance in reasonable installments and a direction may be made to the Family Court concerned for the same. 4. In view of the aforesaid, it is directed that in case the applicant moves an application before Family Court concerned within a period of three weeks from today to pay/ deposit the arrears of maintenance in installments, the same shall be considered and decided expeditiously, in accordance with law. 5.
