JUSTICE RAJIV ROY ORAL ORDER 2 04-08-2025 Heard Mr. Vivekanand Vivek, learned counsel for the petitioner, the State as also Mr. Surendra Kr. Singh representing the respondent no. 10. 2. The present petition has been preferred for the following relief(s): “I. For issuance of an appropriate writ/writs, order/orders, direction/directions commanding the respondents not to register the Patna High Court CWJC No.16236 of 2016(2) dt.04-08-2025 2/3 sale- deed with regard to land of village-Chanda bearing Khata No- 1 Khesra No- 199,200,302,336,249,and 201 to be executed by the respondent No- 6 to 11 who are trying to sell the land on the basis of forged and fabricated Land Possession Certificated issued by the circle officer, Dumraon, Dist-Buxar. II. For issuance of an appropriate writ/ writs, order/orders, direction/directions commanding the respondents to cancel the land possession certificate issued by the circle officer in favour of the respondent No- 10 contained in Annexure- 3 of the application with regard to land in question on the basis of false and fabricated affidavit of the respondent No- 10. III. For issuance of any appropriate writ/writs/order/orders/direction/directions to which the petitioner is entitled in accordance with law.” 3. At the outset, learned counsel representing the respondent no. 10 submits that a Title Suit No. 372 of 2018 is pending before the Court of learned Civil Judge, Dumraon Patna High Court CWJC No.16236 of 2016(2) dt.04-08-2025 3/3 (Buxar) and any interim relief/prayer can be best be entertained by the said Judge and not under “Article 226 of the Constitution”. 4. In that background, taking note of the aforesaid Title Suit which has not been disputed, the writ petition stands disposed of allowing the parties to agitate the matter before the concerned Court and to take all such plea/prayer/prayer for interim protection as they deem fit and proper.
