The instant Criminal Miscellaneous Petition has been filed for modification in the order dated 18.03.2025 passed in Criminal Appeal (DB) No.17 of 2025 whereby and whereunder the appellants, petitioners herein, have been granted anticipatory bail with a direction to surrender before the learned court within four weeks. 2. Mr. Chandan Kumar, learned counsel appearing for the petitioners/appellants has submitted that this Court, while granting anticipatory bail to the petitioners/appellants, had directed to surrender before the learned court within a period of four weeks’ but the appellant/petitioner No.2, namely, Ajay Kumar Sharma, who is aged about 67 years was suffering from Gallbladder Stone (Cholelithiasis). The surgery has been done and the 2025:JHHC:28946-DB 2 appellant/petitioner No.1, namely, Nikki Kumari, being the daughter of appellant No.2, was also engaged in taking care of her father, as such, both could not surrender before the learned court within stipulated time of four weeks. 3. Learned counsel, in that view of the matter, has submitted that the order dated 18.03.2025 may be modified and time for surrendering before the court may be extended for a period of further four weeks. 4. Considering such submission, the order dated 18.03.2025 passed in Criminal Appeal (DB) No.17 of 2025 is modified and the period of time, as has been directed to surrender, is hereby extended for a further period of four weeks from today. 5. The remaining part of the order will remain intact. 6. Accordingly, the instant Criminal Miscellaneous Petition stands disposed of. (Sujit Narayan Prasad, J.)
