The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 111(2)(b), 317(2), 317(4), 317(5), 318(4), 319(2), 336 (3), 338, 340(2) & 3(5) of the B.N.S., 2023 and Section 66(B)(C)(D) of the Information Technology Act, in connection with Jamtara Cyber Crime P.S. Case No.39 of 2025.

Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence and he has been falsely implicated in this case. He further submits that petitioner is nowhere related with any cyber-crime and has been made victim due to high-handedness of the Police. The petitioner has nothing to do with the mobile phones which were used for cyber-crime. Further, there is no victim in the instant case as it appears from the impugned order since nobody has come forward with a claim that he or she has been cheated by the hands of this petitioner. He further submits that petitioner is languishing in custody since 17.05.2025 and the co-accused has been granted bail by this Court in B.A. No. 6585 of 2025; as such, the petitioner may be enlarged on bail. He is ready to abide by every condition imposed by this court.

Mr. S.K. Tiwary, learned Spl. P.P. opposes the prayer for bail of the petitioner.

Having regard to the facts of the case that since the petitioner is in custody since 17.05.2025 and similarly situated co-accused has already been granted bail by this Court, I am inclined to enlarge this petitioner on
2025:JHHC:22585 2 bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Cyber Crime, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.39 of 2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
