HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9880 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The accused-applicant seeks bail in FIR/Case Crime No.0279 of 2025 under section 115(2), 331(6), 352, 70(1), 351(3), BNS, P.S. Motipur, District Bahraich. 3. In terms of the FIR, the informant alleged that on the night of 28/29-05- 2025, the applicant came inside the home and tried to commit wrong on her and when she resisted, she was beaten and thereafter ran away. The injury report on record indicates the injury mark on the neck and around the left eye. In the statement under section 180 BNSS also, the victim alleged that at about 12 night when she was sleeping on cot with her children, the applicant attacked her and thereafter also committed wrong on her. The medical on record does not corroborate the allegation of rape. 4. Considering the age of the victim coupled with the fact that she was sleeping with the child and without there being any resistance, the statement appears to be highly improper and the medical does not corroborate the allegation, the applicant who is in custody since 04.06.2025 and has no criminal history is entitled for the bail. Thus the bail application is allowed. Versus Counsel for Applicant(s) : Shailendra Kumar Counsel for Opposite Party(s) : G.A. Rahul Kumar .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt.
