Rules read with Order VII Rule 1 of Code of Civil Procedure and Section 2(1)(c)(xvii) & Section 7 of the Commercial Courts Act, 2015 and Section 55 and 62 of the Copyright Act, 1957, seeking to (a) Grant a permanent injunction restraining the Defendants, their men, agents, servants, affiliates, and all persons acting on their behalf from in any manner using, reproducing, broadcasting, exhibiting, distributing, or otherwise exploiting any portion of the cinematograph film Chandramuki, including its audio, in the documentary 'Nayanthara Beyond the Fairytale' or any other medium without the express authorization of the Plaintiff (b) Direct the Defendants to render true and proper accounts of all revenue earned by them through the unauthorized usage and exploitation of the Plaintiffs copyrighted content in the documentary and on the 2nd Defendant's digital platform, Netflix (c)Issue a Mandatory Injunction directing the Defendants to take down and remove the infringing portions of the cinematograph film Chandramuki from the documentary 'Nayanthara-Beyond the Fairytale' across all platforms where it has been made available, including but not limited to the 2nd Defendant's OTT platform, Netflix (d) Directing the Defendants to pay the costs of the suit.
