HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9951 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA for the State as well as Mr. Abhishek Mishra, learned counsel for the informant, whose vakalatanma filed today is taken on record. 2. The accused-applicant seeks bail in FIR/Case Crime No.135 of 2025 under Sections 3(5), 103(1), 109(1), 333, 352, 351(3), 115(2) BNS and Section 30 of Arms Act, P.S.- Patti, District- Pratapgarh. 3. Contention of the learned counsel for the applicant is that one of the co- accused, namely, Pragati Dubey has been enlarged on bail vide order dated 08.10.2025 passed by this Court in Criminal Misc. Bail Application No.8425 of 2025, although, he does not claim parity with her. It is argued that no role of causing fire armed injury was assigned to the applicant. It is further argued that the applicant is a license holder of the weapon which was used for the alleged offence and was accompanied by the persons who had caused the offence by firing. 4. Learned AGA has opposed the bail application. 5. Considering the facts and circumstances, prima facie, there appears to be no role of firing assigned to the applicant who is aged about 63 years and is in custody since 10.05.2025. The criminal history of applicant has been explained in para-39 of the present application, thus, I am of the view that the applicant is entitled to be enlarged on bail.
