This anticipatory bail application under Sections 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest in connection with P.C.R. Case No.457/2023, for offences under Sections 406, 420, 504, 506 of the Indian Penal Code. The case is presently pending before the Court of learned S.D.J.M., Madhupur. 3. This case arises out of a complaint. 4. The allegation against the petitioner is that he received Rs.13,50,000/- from the informant and returned only Rs.80,00/- and upon asking, he declined to pay the balance amount and threatened him. 5. The Court has taken the cognizance and has issued the summons to this petitioner. When summons has already been issued in private complaint, this case false within Category-A offences in terms of judgment of Hon’ble Supreme Court in the case of Satender Kumar Antil Vs. Central Bureau of Investigation & Another, reported in (2021) 10 SCC 773. Thus, this petitioner should appear before the concerned Court and on his appearance, appropriate order will be passed in terms of the judgment of Satender Kumar Antil Vs.
