(Oral) As per the observations made in the order dated 03.02.2026, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte. Counsel for the applicant heard. The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 (i) (ia), 13 (1) (ib) of the Hindu Marriage Act i.e. HMA/109/2025, titled ‘Sonu Singla v/s Priyanshy Singla’, filed by the respondent-husband, pending in the Family Court, Budhlada, District Mansa and she seeks transfer of the same to Family Court (Camp Court), Dhur, District Sangrur. 2 TA-1502-2025 It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 04.12.2022. One son born from the said wedlock is in the care and custody of the applicant. On account of the matrimonial dispute, the parties are residing separate. Also, counsel for the applicant submits that earlier also, the respondent had filed petition under Section 9 of Hindu Marriage Act and vide transfer application i.e. TA-1419-2024, filed by the applicant, the said petition was transferred to Family Court (Camp Court), Dhuri, District Sangrur, vide order dated 08.04.2025, copy whereof is Annexure P-1. After the said order being passed ex parte , the respondent had withdrawn the petition under Section 9 of Hindu Marriage Act and filed the present petition, which is now sought to be transferred by the applicant. The applicant is not having any source of earning and has filed petition under Section 144 of Bharatiya Nagarik Suraksha Sanhita as well as complaint under Section 12 of Protection of Women from Domestic Violence Act, which are pending in the courts at Dhuri. Besides the same, the respondent is facing trial in case bearing FIR No.15 dated 27.08.2025 under Section 498-A, 406 IPC, in the courts at Sangrur. Considering the aforesaid submissions and also taking into
consideration the fact about the respondentn having not come forward to resist the application, more particularly, considering the applicant taking care of the minor child, while herself having no source of earning and besides the same, three other litigation arising from the broken marriage, to be already pending in the courts at Dhuri/Sangrur, more particularly, the criminal case, wherein the respondent is required to make appearance, on each and every SONU 2026.02.24 09:10 I attest to the accuracy and authenticity of this document
3 TA-1502-2025 date of hearing, the transfer application is allowed and the petition under Section 13 (i) (ia), 13 (1) (ib) of the Hindu Marriage Act i.e. HMA/109/2025, titled ‘Sonu Singla v/s Priyanshy Singla’, filed by the respondent-husband, stands transferred from the Family Court, Budhlada, District Mansa to the Court of competent jurisdiction at Dhuri, District Sangrur. The requisite record of the aforesaid case be sent by the Family Court, Budhlada, to the District and Sessions Judge, Sangrur. Learned District and Sessions Judge, Sangrur, shall assign the said petition to the Family Court (Camp Court) Dhuri. Even, the parties are
directed to appear before the Family Court (Camp Court) Dhuri, within a period of one month from today onwards.
