Sri Om Prakash, learned counsel for the petitioner at the outset submits that he may be permitted to not press his relief as contained in the petition rather he submits that he wishes to confine his prayer for expeditious disposal of a suit for division of land holding under Section 116 of the U.P. Revenue Code, 2006. Having considered the aforesaid, this Court does not find that there is any legal impediment, accordingly, the learned counsel for the petitioner is permitted to make the necessary amendment during the course of the day. It is in the aforesaid backdrop that the petition is being considered only for expeditious disposal noticing that the suit for division of land holing is pending, accordingly, without entering into the merits, this Court having taken note of the extracts of the order sheets which have been brought on record as Annexure No. 5 is of the opinion that no gainful purpose will be served in keeping the petition pending rather ends of justice can be met by directing the authority concerned to expedite the hearing of the suit under Section 116 of the U.P. Revenue Code, 2006 and the same shall be considered and decided in accordance with law after affording full opportunity of hearing to the parties but without granting any unnecessary adjournments.
