Heard the parties.
The petitioner has been made accused in connection with Jamtara Cyber P.S. Case No. 44 of 2025, for the offence under Sections 111(2)(6), 317(2), 317(5), 318(4), 319(2), 336(3), 338, 340(2) & 3(5) of B.N.S., 2023, Sections 66B, 66C & 66D of I.T. Act and Section 42(3)(e) of the Telecommunication Act, pending in the court of learned Special Judge, Cyber Crime, Jamtara.
On 14.06.2025, Cyber Police Jamtara on the basis of confidential information that unknown cyber criminals have assembled near Parbat Bihar Forest area, raided the place of occurrence and apprehended the petitioner alongwith several co-accused persons.
A mobile phone is alleged to have been recovered from the possession of the petitioner.
It was submitted that no victim has turned up to claim that a seized mobile phone recovered from the possession of the petitioner was used in cheating anybody.
Learned Spl.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, Cyber Crime, Jamtara, in connection with Jamtara Cyber P.S. Case No. 44 of 2025.
