Custody certificate of the petitioner filed in the Court today is taken on record.

This appeal has been filed against the conviction and sentence under Section 18 of NDPS Act and under Section 489 of IPC and was sentenced to undergo imprisonment for one year with fine of Rs.2,000/- in default of further rigorous imprisonment for one month. While patrolling, police party stopped the motorcycle and opened the side bags of the motor cycle and when it was opened it contained opium. The statement of the accused was reduced into writing and after deducting the sample the opium was fit which came to 180 Grams thereby constituting the entire recovery of 200 Grams of opium.

Counsel for the petitioner does not raise any contention on merits however, states that since the contraband recovered was not of commercial quantity and the petitioner is not involved in any other case till date considering the above facts that he has already undergone sentence of four months and 20 days incarceration.
