The petitioner is filed this petition seeking following relief:- 10.1 That, this Hon'ble Court may kindly be pleased to quash the impugned order Dated 02.02.2018 (P/1) issued by CEO, Zila Panchayat Raigarh 10.2 Hon'ble Court may kindly be direct the respondent State to consider the candidature of petitioner for appointment on the post of Lecturer (Panchayat) on the basis of mark- sheet of M.Sc. of the Mats University. 10.3 The Hon'ble Court may kindly grant any other writ/ writs, order/ orders, relief/ reliefs in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner. 2. Learned counsel appearing for the petitioner would submit that the candidature of the petitioner for the post of Lecturer in the subject of Science, pursuant to the advertisement dated 22.07.2017, was rejected on the ground that the petitioner acquired post-graduate qualification from MATS University in the academic year 2014-15, and on that date, the same qualification was not recognized. He would contend that a representation was made and the same was rejected by the Chief Executive Officer, Zila Panchayat, Raigarh/Respondent No. 4, vide order dated 02.02.2018. He would further contend that the petitioner was enrolled to pursue M.Sc. through distance education in the year 2014 and at that point of time, such a degree was recognized by 3 the University Grants Commission. He would contend that the respondents may be directed to consider the claim of the petitioner. 3. On the other hand, Mr. Gupta appearing for the State would submit that for the academic year 2014-15, the course of M.Sc. through distance learning was not recognized by the University Grants Commission. Therefore, the candidature of the petitioner was rejected. He would contend that the petition deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents available on record. 5. Perusal of the order impugned and the list issued by the University Grants Commission regarding recognition of courses, it is quite vivid that the course of M.Sc. through distance learning from MATS University for the academic year 2014-15 was not recognized. Therefore, the candidature of the petitioner was rightly rejected. I do not find any good ground to allow the instant petition. 6. Accordingly, the present petition is dismissed at motion stage.
