Learned counsel for the petitioner submits that the petitioner is the younger son of the deceased employee, who died in harness while serving as a Peon in the Railway Department. Upon the demise of the said employee, the elder brother of the petitioner submitted an application seeking compassionate appointment before the respondent authorities. It is further submitted that Respondent No.3 filed Original Application No. 203/614/2019 before the Central Administrative Tribunal, Jabalpur Bench, Circuit Sitting at Bilaspur, which was decided in favour of Respondent 3 No.3 by order dated 11.07.2022, directing the grant of compassionate appointment. The learned counsel for the petitioner further submits that the present writ petition has been filed to challenge the aforesaid order, and seeks to raise certain grievances in this regard. 2. From a perusal of the reliefs sought in the petition, it appears that if the petitioner is aggrieved by the order passed by the Central Administrative Tribunal, the proper course of action would be to file an appropriate application or Original Application before the competent Court/Forum. However, no such recourse has been taken by the petitioner, and therefore, this Court is of the view that the present petition, being without jurisdiction, is not maintainable. 3. In view of the above, learned counsel for the petitioner seeks permission to withdraw the writ petition, with liberty to approach the appropriate Court/Forum by filing a suitable application or Original Application in accordance with law. 4. Accordingly, the writ petition is dismissed as withdrawn, with liberty reserved in favour of the petitioner to file an appropriate application/Original Application before the competent Court/Forum, if so advised.
