COMMON ORDER: Both these criminal petitions have been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brev'lty lthe BNSS') by the petitl'oner / Accused Nos.3 and 4 for granting pre-arrest bail in connection with Crime No,234 of 2025 of Gajuwaka Police Station, Visakhapatnam District, registered for the offences punishable under Sections 318(4) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity lthe BNS') and under Sections 21(1)(2)(3), 23 of the Banning of Unregulated Deposit Schemes Act, 2019. 2. Since both the criminal pet-ltions are arising out of the same cr'lme, they are being disposed by way of this common order. 3. The case of the prosecution is that the complainant used tO WOrk at the house of accused (Mudunuri Ch'lttemma) at Srinagar Official Colony for a daily wage of Rs.150/-per day. All the accused is doing lottery business and used to collect deposits from the victims. The accused siphoned an amount of /
EREg¥g%-#z3--g- , a,I+S. -I Rs.1,54,88,000/-, which was collected from the victims in the name of some .a ._=~{e* unofficial schemes and absconded without repaying the same'. Thereby, all the accused have committed the aforesaid offences. 4. Sri V.Nitesh, learned counsel for the petitioners, submits that the petitioners have not committed any offence; they were falsely implicated in this case; they are sole breadwinners of their respective families; they are ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioners on bail. 5. Per cot,fra, Ms.P.Akhila`Naidu, the learned Assistant Public Prosecutor, opposed in grantlng of bail stating that inve;}igaJi;= I;;not yet completed, if the petitioners are granted pre-arrest bail, tr© will repeat the same E=6- offence and urged to dismiss the bail petition. 6. Perused the record. 7.
The petitioners, who are A3 and A4, are the daughter and son of Accused Nos.1 and 2. AIthough, there is a reference about their two names in esat`__ .` the F.I.R. lodged by the de facto complainant that along with Al and A2, these two petitioners have collected deposits from the de facto complainant and other persons, A3 is a student pursuing her studies in UnI'ted States of t\ America, who has nothing to do with this case from America. Similarly, A4 is also a. student, aged about 23 years. It 'ls also stated that Learned Special
Judge for Trial of Cases under BUDS Act-Gum-Principal District andc- Sessions Judge, Visakhapatnam vide order dated 15.07.2025 passed in Crl.M.P.No.785 of 2025, has granted bail to A1 land A2. 8. Considering the nature of the nature of the allegations levelled against the petitioners and their alleged role played in this case, I am inclined to grant pre-arrest bail to the petitioners. 9. ln the result, the Criminal Petition is allowed with the following stringent conditions: i. In the event of their arrest, the petitioners / Accused Nos.3 and 4, shall be enlarged on bail subject to executing a personal bond for a sum of Rs.25,OOO/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the arresting police officials. ii. The petitioners / Accused shall make themselves available for investigation as and when required; iii.
