Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam. 2. This application has been filed by the petitioner, namely, Sultan Ali Ahmed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking bail in connection with Bongaigaon P.S. Case No.98/2025 under Page No.# 2/2 Sections 303(2)/ 317(2)/ 317(4)/ 112 of the BNS, read with Section 23 of the Petroleum Act, 1934. 3. The allegation against the petitioner as far the FIR pertains to theft of oil products. Earlier his bail petition was rejected by this Court vide order dated 19.09.2025. 4. In the meantime, the co-accused of the case has been granted bail by order dated 26.09.2025 in Bail application No.2992/2025 primarily on the ground of length of detention. In the present case, the petitioner has completed 77 days in judicial custody and moreover, the investigation of the case has also progressed. 5. Considering the above, the prayer for bail is allowed. 6. It is hereby directed that the petitioner, Sultan Ali Ahmed, who was arrested in connection with Bongaigaon P.S. Case No.98/2025 shall be released on bail on furnishing a bail bond of Rs.50,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Bongaigaon. 7. With the aforesaid direction, this Bail Application stands disposed of. JUDGE Comparing Assistant
