Advocate (Crl.side) O R D E R This writ petition (crl.) has been filed to direct the 1 st respondent to de-freeze the petitioner’s Bank account bearing No.041327000000839 lying with the 2 nd respondent bank to enable him to operate the same, by considering the representation dated 06.10.2025. 2.When the matter was taken up today, the learned Govt. Advocate (Crl.side) appearing for the first respondent would submit that based on a complaint given by one Barath stating that he had been cheated online, an enquiry was conducted in CSR No.317 of 2025. During the course of the 2/5 https://www.mhc.tn.gov.in/judis W.P.(Crl) No.1373 of 2025 enquiry, it came to light that a sum of Rs.5,80,000/- had been transferred from Barath’s account to a first-layer account, and thereafter the said amount had been transferred to the account of the petitioner. At the request of the first respondent police, the said account was frozen. Subsequently, by order of the learned Judicial Magistrate No.I, Alandur (FAC) in C.M.P.No.4299 of 2025 dated 04.09.2025, the amount was transferred to the account of the complainant. He would further submit that as on today, there is no other complaint pending on the file of the first respondent, though he understands that there are other complaints pending before various agencies in respect of the account. He would further submit that the first respondent will issue a communication to the second respondent to defreeze the account within a period of one week from the date of receipt of a copy of this order.
