The appellant has filed the instant appeal under Section 19 (1) of the Family Court Act, 1984 against the impugned judgment & decree dated 27.04.2024 (Annexure A-1) passed in Civil Suit No. 592/2022 by the learned Family Court, Raipur, District- Raipur (C.G.), whereby the learned Family Court after hearing the parties, dismissed the suit and held that the respondent’s first marriage was dissolved and she got divorce from her first husband by executing an agreement before their parents and Panch (5 people) as per Sikh Rituals. Hence, this appeal. 2. During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 30.07.2025, the matter was referred to Mediation Centre Digitally signed by AMIT PATEL 2 of this Court and both parties have settled their dispute before the Mediation Centre on 04.08.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 04.08.2025, which was duly signed by them. 3. Operative paras of settlement agreement dated 04.08.2025 are as under:- “ माननीय उच्च न्यायालय के आदेश दिदनांक 30.07.2025 के परिपालन में यह प्रकण के FA (MAT) No. 160/2024 (Satish Khatri Vs. Sonam Ahuja) में मध्यस्थता हेतु प्रेदित दिकया गया जि सके पश्चात दिदनांक 30.07.2025 एवं 04.08.2025 को एकल सत्र एवं संयुक्त सत्र लिलया गया उपांत दोनो पक्षकाों के मध्य मध्यस्थता प्रदिकया संपन्न दिकया गया। आवेदक स्वयं उपस्थिस्थत। अनावेदिदका स्वयं उपस्थिस्थत। आ दिदनांक 04.08.2025 को आवेदक व अनावेदिदका ने मध्यस्थता के न्द्र में दिनम्नलिललि1त शत2 प यह समझौता हुआ दिक उभयपक्ष कु टुम्ब न्यायालय, ायपु के समक्ष उपस्थिस्थत होक आपसी सहमतित से दिववाह दिवच्छेद का आवेदन एक माह के अंद प्रस्तुत केंगे। अनावेदिदका सोनम आहू ा द्वाा भण- पाण हेतु प्रस्तुत आवेदन धाा 144 बी.एन.एस.एस. जि सका प्रकण क. MCC/92/2025 है ो दिदनांक 18.08.2025 को माननीय कु टुम्ब न्यायालय, ायपु के समक्ष लंदिबत है। उपोक्त प्रकण को अनावेदिदका मध्यस्थता के आधा प प्रकण वापस लेगी। आवेदक द्वाा माननीय उच्च न्यायालय के समक्ष लंदिबत प्रकण FA (MAT) No. 160/2024 (Satish Khatri Vs. Sonam Ahuja) को आपसी सहमतित से दिववाह दिवच्छेद एवं अनावेदिदका द्वाा भण- पोण का प्रकण वापस लिलए ाने के पश्चात वापस लेगा। आवेदक एवं अनावेदिदका द्वाा सगाई एवं दिववाह के दौान एक दूसे को दिदये गए आभूण दिदनांक 18.08.2025 को कु टुम्ब न्यायालय, ायपु के समक्ष हस्तांतरित केंगे। अनावेदिदका के दिपता द्वाा आवेदक के दिपता को दिदनांक 01.04.2022 को 50,000/- ( पचास ह ा रूपये) की ाशिश एवं 70,000/- ( सत्त ह ा रूपये) के दो पृथक तिFमांF F्राफ्ट अनावेदिदका के सेन्ट्रल बैंक ऑफ इंतिFया अकाउंट न. 5361700540 के नाम से बनवाएगा एवं उपोक्त तिFमांF F्राफ्ट दिदनांक 18.08.2025 को माननीय कु टुम्ब न्यायालय, ायपु के समक्ष प्रदान केगा। उभयपक्ष आपसी सहमतित से दिववाह दिवच्छेद का आवेदन दोनों पक्षों द्वाा बाब- बाब वहन दिकया ावेगा । भदिवष्य में आवेदक एवं अनावेदिदका एक दूसे के दिवरुद्ध कोई कानूनी कायQवाही एवं दिकसी भी प्रका ही दावा आपलित्त नहीं केंगे। 3 उभयपक्ष इस समझौता पत्र की शत2 से सहमत है एवं पालन के लिलए कदिटबद्ध है समझौता पत्र में दी गई शत2 को उन्होंने अपनी स्वयं की स्वेच्छापूवQक सहमतित एवं दिबना दिकसी दबाव, भय एवं लालच के स्वीका दिकया गया है। उभयपक्ष ने इस समझौता पत्र की शत2 को पढ़ने व समझने के पश्चात अपनी स्वतंत्र सहमतित से पस्प एक- दूसे की उपस्थिस्थतित में हस्ताक्ष क दिनष्पादिदत दिकया। " दिबलासपु (छ.ग.) दिदनांक 04.08.2025. प्रथम पक्ष………… ...Sd/-……... दिद्वतीय पक्ष………… .Sd/-……….. Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 04.08.2025. 5. We have heard learned counsel for the respective parties. 6. In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 04.08.2025, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 04.08.2025, will form part of this judgment/decree. 7.
