Side) 2/7 https://www.mhc.tn.gov.in/judis Crl.O.P.No.31658 of 2025 O R D E R This Criminal Original Petition has been filed to issue a direction to the respondents herein to transfer the investigation in Crime No.320 of 2025, registered for the offences under Sections 296(b), 115(2) and 118(1) of BNS, on the file of the 3 rd respondent police to any other police station. 2. The learned counsel for the petitioner would submit that the petitioner was abused and attacked by 3 persons viz., Kalaivani, Kaveri and Palanisamy. Hence, he lodged a complaint before the 3 rd respondent police. Though the 3 rd respondent police registered a case in Crime No.320 of 2025, against the said Kalaivani and Kaveri S/o.Gopal Gounder, they have now shown the said Palanisamy as an accused. He would further submit that the 3 rd respondent police are not conducting a proper investigation. Hence, the present petition is filed seeking transfer of investigation. 3. The learned Government Advocate (Crl. Side) appearing for the respondents police would submit that this is a case of case and counter case. Based on the complaint lodged by the petitioner, the FIR in Crime No.320 of 2025 has been registered and on the complaint lodged by Kaveri, the 3/7 https://www.mhc.tn.gov.in/judis Crl.O.P.No.31658 of 2025 counter case has been registered in Crime No.321 of 2025. He would further submit that the said Palanisamy has also been impleaded as an accused and the investigation is going on in a proper manner. He would also submit that the case was registered recently on 26.09.2025. 4. Taking into consideration the submissions made by the learned Government Advocate (Crl. Side), this Court is of the opinion that the prayer sought by the petitioner need not be granted. 5. However, a direction is issued to the second respondent to monitor the investigation in both the cases viz. Crime Nos.320 and 321 of 2025 on the file of the 3 rd respondent police and the final reports in both the cases shall be filed within a period of three months from today. 6.
