This application filed under section 483 of the Bharatiya Nagarik Suraskha Page No.# 2/3 Sanhita, 2023, the accused petitioner namely, Mamoni Khatun @ Mamani Khatun, has prayed for bail in connection with Bharulumukh P.S. Case No. 132/2025, registered under Section 21(b) of NDPS Act. 3. It has been submitted by the learned counsel for the petitioner that the petitioner has been detained in judicial custody since 05.09.2025. 4. The allegation is about recovery of suspected heroine of intermediate quantity (25.09 grams) including the plastic container from the possession of the present petitioner. 5. Case diary has been received which indicates completion of investigation resulting in charge sheet against the accused under Section 21(b) of NDPS Act. 6. The learned Additional Public Prosecutor submits that investigation has not only found incriminating materials with regard to the present offence but also it is revealed that the petitioner has been involved in peddling of narcotic drugs since sometime. 7. Nevertheless, considering the completion of investigation, I deem it fit to grant bail to the petitioner, subject to strict conditions. 8. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Bharulumukh P.S. Case No. 132/2025, registered under Section 21(b) of NDPS Act, on furnishing bail bond of Rs.50,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court [Special Judge, Kamrup(M)]. 9. The direction for bail is further subject to the conditions: (a) That the petitioner shall not abscond; (b) That the petitioner shall be available during trial; if one commences; (c) That the petitioner shall not hamper or tamper with evidence; (d) shall not intimidate or harass or try to influence any witnesses; and Page No.# 3/3 (e) shall not indulge in any illegal activity of consuming or peddling of narcotic drugs. 10. Violation or breach of any condition(s) shall entail cancellation of bail. 11. With the above observations, this bail petition stands allowed and disposed of accordingly. 12.
