Chatterjee, Advocate ---- 2/12.08.2025 Heard the learned counsel for the petitioner as well as the learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Sector 12 P.S. Case No.71 of 2024, for the offence registered under sections 379 of BNS, 2023 and section 21 of MMDR Act, 1957, pending in the court of learned Judicial Magistrate, First Class, Bokaro. 3. Learned counsel for the petitioner submits that petitioner is the owner of the vehicle in question which was loaded with 100 cft sand and the petitioner has got no criminal antecedent as disclosed in paragraph no.12. 4. Learned counsel for the State opposed the prayer and submits that 100 cft sand was loaded on the vehicle of the petitioner. 5. Considering that the petitioner is the owner of the vehicle in question and was not present on the spot and the petitioner is also not having criminal antecedent, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, First Class, Bokaro, in connection with Sector 12 P.S. Case No.71 of 2024, subject to the conditions as laid down under section 482(2) of the Bhartiya Nagrik Suraksha Sanhita (BNSS). ( Sanjay Kumar Dwivedi, J.) SI/
