1. This is an ofÏce reference.
2. This Court, vide order dated 21.08.2024, passed in MCRC No. 5473 of 2024, while allowing the bail to the applicant, namely, Gitesh Patro, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of production of the order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act), Saraipali, District- Mahasamund (C.G.) vide his request letter dated 16.04.2025 has KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD that in this case, the testimony of only 2 prosecution witnesses have been recorded so far. As per the trial schedule, the testimony of 11 witnesses remains to be recorded. Despite issuing bailable and non-bailable warrants, the remaining witnesses have not been presented and their testimony could not be recorded due to their absence. The case was first listed before the present presiding ofÏcer on April 15, 2025, for trial. Subsequently, summons and arrest warrants were issued through the Superintendent of Police, Mahasamund, on April 28, 29, and 30, 2025, to ensure the attendance of prosecution witnesses. After recording the testimony of the remaining 11 prosecution witnesses, the statement of the accused, final arguments, and defence evidence will be taken up therefore, it is likely to take some time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of five months from today, if there is no legal impediment.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
