HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11929 of 2025 Court No. - 18 HON'BLE SHREE PRAKASH SINGH, J. Sri P.K.Singh 'Vats' Advocate has put in appearance by way of filing Vakalatnama on behalf of opposite party no. 4 and the same is taken on record. On 09-10-2025, the following order was passed:- "1. Learned counsel for the petitioner, at the very outset, is given liberty to implead "Principal, Shri Ramdev Bhikhi Ram Laghu, Madhyamik Vidyalaya, Akbalpur Salahpur, District Ambedkar Nagar" as respondent no. 3 in the array of respondents. 2. Learned counsel for the respondents have no objection to the prayer made. 3. In view of the aforesaid, the learned counsel for the petitioner is permitted to implead "Principal, Shri Ramdev Bhikhi Ram Laghu, Madhyamik Vidyalaya, Akbalpur Salahpur, District Ambedkar Nagar" as respondent no. 3 in the array of respondents, during the course of the day. 4. Learned counsel for the petitioner submits that the petitioner retired from services on 31.12.2022 and he has not been paid salary for the period 2006- 2012 and the reason shown for the same is that the period of working of the petitioner has not been verified by the Principal of the college. 5. He further submits that the petitioner is a retired employee and is running pillar to post on the pretext that his salary for the period 2006-2012 has not been verified. 6. Learned counsel appearing for respondent no. 3 has submitted that the petitioner has already approached this court wherein, this court has passed an order on 22.05.2025 and the Manager, Committee of Management was directed to verify the record of the petitioner and the same has been verified by the committee of management and the report was submitted on 21.07.2025. To resolve the controversy, the District Basic Education Officer, Ambedkar Nagar, Manager, Committee of Management, Shri Ramdev Bhikhi Ram and the Principal of the institution shall remain present before this court on 14.10.2025 at 2:15 P.M along with the relevant records, so that the records of working of the petitioner from 2006-2012, can be verified. 8. Shri Devesh Pathak, learned Additional Chief Standing Counsel shall communicate this order to the concerned authorities. " In compliance of the order aforesaid,the Principal of the College as well as the District Basic Education Officer, Ambedkar Nagar, are present in person before this court. It has been submitted by the learned counsel for the Manager that she is a woman, though she has come in the campus of the High Court, but she is unwell and therefore, she could not appear before this court. Learned counsel appearing for the Manager has placed before this court the register, which is evident that the attendance of the petitioner while putting his signature is over there. Learned counsel for the petitioner submitted that the petitioner was not paid the salary from the year 2006 to the year 2012 and the reason behind the same is that the Manager and the Principal of the college did not place the register/record before the District Basic Education Officer. Considering the aforesaid and particularly, the fact that the present petitioner has signed over the attendance register started from the year 2006 to the year 2012, the order dated 30-08-2025 is hereby kept in abeyance. The petitioner is directed to move his claim afresh before the District Basic Education Officer, Ambedkar Nagar regarding the payment of salary since the year 2006 to the year 2012 as is due to him, within fifteen days from today and on such representation, the District Basic Education Officer,Ambedkar Nagar, after calling the relevant records from the Manager as well as the Principal of the Committee of Management of the institution, shall pass a fresh order with respect to payment of salary to the petitioner within further period of two months. WRIA No. 11929 of 2025 2 The Manger and the Principal of the college are directed to place the attendance register including other relevant records, which are sought by the District Basic Education Officer, Ambedkar Nagar to deal with the matter as soon they receive the notices from the District Basic Education Officer. The District Basic Education Officer shall also record the statement of the then Principal, with whom the petitioner was working since the year 2006 to the year 2012. With the aforesaid observations, the instant writ petition is disposed of. The presence of the Principal of the College, Manager of the Committee of Management of the institution as well as the District Basic Education Officer, Ambedkar Nagar, are hereby exempted.
