Following the principles laid down by the Full Bench judgment of this Court in another 2007 (3) RCR (Criminal) 1052 Court in Gian Singh Versus State of Punjab and others (2012) 10 SCC 303 this petition is allowed and Sections 324, 323, 148, 149 of IPC as wel M No. 6150 of 2025 and CRM-M No. 6153 of 2025 subsequent proceedings arising therefrom, on the basis of compromise dated 08.01.2025 (Annexure P-2). This Court vide orders dated 14.01.2025 (in CRM and 04.02.2025 ( in CRM-M-6150-2025) and thereafter 06.03.2025 (in both cases) had directed the parties to appear before the trial Court to get their statements recorded and the learned Magistrate was directed to send its report qua the genuineness of the compromise. Pursuant to the aforesaid order, parties have appeared before the Sub Divisional Judicial Magistrate, Sardulgarh recorded. On the basis of the statements so recorded, learned submitted report dated 15.04.2025 to the effect tha effected between the parties voluntarily and without any coercion or undue Learned State counsel as well as counsel for disputed the factum of compromise between the parties.
