2. Case of the prosecution, in brief is that on 24.02.2025, the defacto complainant, a railway contractor, reported to the police that he had advanced approximately Rs.89.00 lakhs in loans to Kathija Begam, who agreed to settle the debt by selling her Ac.9.18 cents of agricultural land to him. After the deaths of her two sons (in 2009 and. 2015, respectively), Kathija.
was the sole occupant of the property. However, before the sale deed could be executed and registered, Kathija Begam passed away. Subsequently, B. Yatendra Ramu misled the defacto ,complainant, promising to facilitate the sale through revenue authorities but failed to complete the necessary procedures. When the defacto comp'ainant attempted to lodge _a police complaint, a then-serving MLA allegedly threatened him with dire consequences at his office in Gannavaram, with the backing of his followers and the accused conspired and forged documents, impersonating fictitious legal heirs of Kathija Begam. Using these forged identities, they fraudulently sold the land to third parties, depriving the defacto comp'ainant of his rightful claim to the property. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent/State. Perused the record. 4. A perusal of the First Information Report goes to show that the only accusation that has been made against the- petitioner herein is that he, along with others] are alleged to have threatened the defacto complainant with dire consequerlces. Except the said \- i,.`. accusation, there is no other allegation to connect the petitioner in the present crime. 5. In viewofthe facts and circumstances of the case, this court is inclined to consider the request of the petitioner/A5 for grant of anticipatory bail, however, on conditions. 6. Accordingly, in the event of his arrest in the above said crime, the petitioner/A5 shall be released on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only), with two sureties each for the like sum to the satisfaction of the arresting POIice officials and also on condition that the petitionershall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the Prosecution Witnesses. The petitioner shall appear before the station House Officer concerned, once in a week i.e. on every sunday between 10.00 AM and 1.00 PM, till filing of the charge sheet. 7. Accordingly, the criminal petition is allowed.
