The instant application has been filed by the applicant, seeking condonation of delay in filing appeal against the order of the trial Judge dated 20.12.2024 .

For the reasons stated in the application, the same is allowed and delay in filing the appeal is condoned.

When the matter was taken up on 03.03.2025 & 09.07.2025, none appeared for the petitioner. Today also, nobody has come present on behalf of the appellant to press this appeal. Otherwise also, this appeal by the appellant, namely, Mohd. Khalil Lone is directed against the order dated 20.12.2024 passed by the learned Additional District & Sessions Judge, designated Special Judge, Poonch (hereinafter referred to as the,

“trial Court”) under ULAP Act, whereby the bail application of the appellant (respondent No. 1 herein) has been rejected. From perusal of the record, it transpires that the said application was moved by the appellant before the trial Court at a stage, when the investigation in FIR No. 142/2024 was going on.

Mrs. Monika Kohli, learned Sr. AAG would submit that during the pendency of this appeal, the investigation has been completed and after fulfilling requisite formalities, the challan has been filed before the same Court. In view of the presentation of the challan, the situation is undergone a change and, therefore, it would be advisable for the appellant to move a fresh application before the trial Court. Probably, because of this reason, the appellant has lost interest to pursue this application.

For the foregoing reasons, the instant appeal is disposed of, with liberty to the appellant to approach the trial Court by way of a fresh application, if so advised. (Sanjay Parihar) (Sanjeev Kumar) Judge
