2. The petitioner is apprehending his arrest in connection with Chandrapura P.S. Case No.76 of 2023 G.R. case No.688 of 2023 for the alleged offences registered under Sections 379 and 411 of Indian Penal Code, pending in the Court of learned SDJM, Bermo at Tenughat.

Learned counsel appearing for the petitioner submits that the petitioner is the driver of TATA 407 vehicle and the allegations are made that iron scrap has been alleged to be loaded on the said vehicle. He submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.15 of the petition. He further submits that the petitioner has already complied the notice

received under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023.

Learned counsel appearing for the State opposes the prayer and submits that iron scrap has been loaded on the vehicle.

In view of the above and considering that the petitioner has complied the notice received under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and the petitioner has got no criminal antecedent as disclosed in paragraph No.15 of the petition, the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
