HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9891 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.404 of 2025, under Sections 108 BNS, P.S. Inayat Nagar, District Ayodhya. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that the deceased was found dead with suicide note. In the suicide note the name of the applicant was named stating that she has committed suicide because of applicant and one Anjali. The cause of death as per post mortem report is ante mortem hanging. Considering the cause of death and there being name of the applicant in the suicide note still the offence of Section 108 BNS is prima facie not made out as the act of the applicant would not amount to abetment defined under the Act and in terms of law laid down by Hon'ble Supreme Court in the case of Mariano Anto Bruno and Anr vs Inspector of Police, 2022 SCC Online SC
1387. 4. Learned AGA has opposed the bail application. 5. Considering the facts and circumstances, however, without commenting upon the merits of the case, the applicant who is in jail since 15.8.2025 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed. Versus Counsel for Applicant(s) : Kailash Nath Mishra, Rahul Mishra Counsel for Opposite Party(s) : G.A. Golu @ Anand .....Applicant(s) State Of U.P.
