The accused/applicant has moved this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for releasing him on regular bail during trial in connection with Crime No.301/2022, registered at Police Station City Kotwali, District Mungeli (C.G.) for the offence punishable under Sections 294, 323, 506, 324 & 307/34 of IPC. The prosecution story in brief is that the applicant is alleged to have assaulted the injured along with other co-accused persons by knife, as a result of which injured sustained injuries and were hospitalized. Based on this, offence has been registered against the accused persons. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that the main allegation is against the co- accused persons and the co-accused Lucky, Mahesh Sahu and Somu have already been acquitted by the learned Trial Court vide judgment dated 22.11.2022. Therefore, the applicant may kindly be released on bail. 4. On the other hand, learned State counsel opposes the bail application of the applicant. 5. I have heard learned counsel for the parties and perused the case-diary. 6. Taking into consideration the facts and circumstances of the case, nature of allegation and further considering the fact that the co-accused persons have already been acquitted by the learned Trial Court, this Court is of the view that it is a fit case to release the applicant on bail. 7. Accordingly, the bail application is allowed. Applicant/accused is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety of the like amount to the 3 satisfaction of the Trial Court.
