Learned counsel for the petitioner submits that for running the Course of GNM Nursing Course, the issue of grant of No Objection Certificate (for short, “NOC”) is pending before the State Authorities since 2022 and till date, the said application submitted by the petitioner seeking NOC has not been decided by the respondents. Counsel submits that by way of passing interim orders by this Court, admissions have been granted to the several [2025:RJ-JP:27305] (2 of 2) [CW-8618/2025] students, but in the absence of NOC in favour of the petitioner, those students studying in the petitioner-institution are not in a position to apply for scholarship, hence, under these circumstances, interference of this Court is warranted. 2. Considering the submissions made by counsel for the petitioner and looking to the fact that the application seeking NOC is lying pending before the respondents since last more than three years and it is not expected from the State-Authorities to sit over the matter and does not decide the same finally. 3. In view of the above factual aspect of the matter, the instant writ petition stands disposed of by issuing directions to the respondents to decide the pending application (if any) expeditiously as early as possible, preferably within a period of three months from the date of receipt of certified copy of the order. 4. Before parting with the order, it is made clear that respondents would be at liberty to decide the application submitted by the petitioner seeking NOC on its merits. This Court has not issued any direction/ order to decide the said application in a particular way and it is expected from the respondents to decide the said application by passing a reasoned and speaking order. 5. Accordingly, the instant writ petition stands disposed of. Stay application and all pending application(s), if any, also stands disposed of. (ANOOP KUMAR DHAND),J Aayush Sharma /29
