JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 4 27-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offence under Sections 103 and 3 (5) of the Bhartiya Nyaya Sanhita, 2023. 3. The prosecution case, in brief, is that on 21.06.2025 at about 9 PM, when informant tried to call her husband on mobile phone, it was ‘switched off’ and on search, his dead body was found in a bamboo clump. Informant suspects that all the named accused persons, including this petitioner, committed the murder of her husband. 4. Learned counsel for the petitioner submits that due to old enmity, petitioner has been falsely implicated in this case. Informant is not eye witness to the occurrence and only suspicion has been raised. During investigation, none of the witnesses claimed to have seen this petitioner committing the Patna High Court CR. MISC. No.84412 of 2025(4) dt.27-02-2026 2/2 alleged offence. Save and except suspicion, there is no other material against this petitioner to show his complicity in the alleged occurrence. Similarly situated co-accused persons have already been granted anticipatory bail by this Court, vide order dated 17.02.2026 passed in Cr.Misc. No. 86901 of 2025. Petitioner claims clean antecedent. 5. Learned A.P.P. for the State has opposed the bail petition. 6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Jaynagar P.S.
