1. Heard the parties. 2. The petitioners apprehend their arrest in connection Ram Krishna Nagar P.S. Case No. 377 of 2023 dated 19.06.2023 registered under Section 147, 149, 323, 307, 332, 333, 338, 353, 504, 427, 506 of the I.P.C.
3. As per the first information report on 19.06.2023 the Police personnel were doing their work in the Police Station. All of a sudden, at about 15:30 Hours, 100 - 150 people along with the petitioners of village: Bhupatipur Mushahari gathered near the Police Station, started abusing the Police personnel, created ruckus and resorted to stone-pelting due to which S.I. namely Shambhunath Singh sustained injury on his head. No.12820 of 2025(2) dt.21-02-2025 2/4 persons became berserk, damaged the vehicles, tables, chairs of the Police Station and another staff Bhag Narayan Rai received injury due to brick batting. The accused persons forcibly entered into the Police Station and upon arrival of the additional force they were controlled. 4. Learned counsel for the petitioners submits that one Chotu Manjhi was taken into custody by the Police on 16.06.2023 and subsequently he died on 19.06.2023 in jail as per the statement of the Police party. In the post mortem report, several bruises and signs of assault was found on the dead body. As such, the villagers got agitated and started making protest near the Police Station. In the lathi charge resorted by the Police party upon the mob, one lady namely Vasantia Devi died. The petitioner no. 1 is a woman and there are other accused persons in the first information report along with some unknown persons. Similarly situated co-accused / Sinki Devi, Laxmi Devi and Pramila Devi have been granted anticipatory bail by this Court vide Cr. Misc. No. 79084 of 2023. 5.
Regard being had to the submission made by the parties, taking into consideration the fact that petitioner no. 1 / Jiramati Devi is a lady and similarly situated co-accused has been granted anticipatory bail, as such, I am inclined to grant

The petitioner no. 2 / Logi Manjhi is named in the First Information Report and it is alleged that he along with the mob attacked the Police Station with impunity causing damage to the government property and injuries to the Police personnel. An attack on Police team while on official duty undermines the safety and security of the law enforcement agencies. Incidents of mob violence against law enforcement agencvies have become order of the day now in this State which can be very dangerous, often escalating tensions and compromising public safety. Learned Additional Sessions Judge-XX, Patna while rejecting the anticipatory bail application has taken note of the materials brought in the case diary during the course of investigation including the CCTV footage in which the accused persons have been seen attacking the Police Station. Moreover, this Court has rejected the anticipatory bail application of similarly situated co-accused persons Guddu Manjhi @ Guddu Kumar @ Badal Manjhi and Gotelal Manjhi @ Golatan Kumar on similar allegation vide Cr. Misc. No. 74080 of 2023. Accordingly, I do not find any reason to differ with the decision of learned Additional Sessions Judge- XX, Patna rejecting the anticipatory bail application of the petitioner no. 2. 7. In the result, the prayer for grant of anticipatory bail to the petitioner no. 2 is rejected. 8. Let the petitioner no. 1, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs.
10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravi Prakath, J.M FC-15, Patna in connection with Ram Krishna Nagar P.S. Case No. 377 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
