HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10041 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J. Case called out. Nobody is present to press the petition although the cause list shows two learned counsel representing the petitioner and no request for adjournment of the case is made on their behalf. Heard Shri S.K. Khare, the learned Standing counsel and perused the record. By means of the instant petition, the petitioner has challenged the validity of an order passed by the District Magistrate, Barabanki in Case No.4353 of 2023 under Section 14 of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 as well as the possession notice dated 03.09.2025 issued by Tehsildar, Tehsil Haidargarh, Barabanki. Learned Standing Counsel has raised a preliminary objection against maintainability of the writ petition that the petitioner has got a statutory remedy of filing a Securitization Application under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before the Debt Recovery Tribunal. Accordingly, the instant petition is dismissed in view of the availability of statutory remedy to the petitioner.
