ORDER:- This Criminal Petition is filed under Section 482 of Cr.P.C., seeking to quash the proceedings against petitioner/accused No.1 herein in Crime No.191 of 2019 on the file of Eluru Police Station for the offence punishable under Section 420 r/w 34 of IPC and Sec.3 & 4 of APGA (Andhra Pradesh Gaming Act)
2. Today, when the matter came up for hearing, learned Public Prosecutor produced a copy of instructions furnished by the Sub-Inspector of Police, Eluru Rural Police Station, the case was investigated by the Investigating Officer, and subsequently, a charge sheet was filed against the accused No.1 herein in the Court of learned Special Judicial Magistrate of 1st Class (Excise), Eluru. The case was registered as C.C.No.292/2022, and the Court below has concluded the trial and the petitioner/accused No.1 was not found guilty for the offence U/Sec.3 of A.P. Gaming Act and accordingly he is acquitted U/Sec.255(1) of Cr.P.C and remaining accused persons are admitted. Therefore, the cause in this petition does not survive and the matter has become infructuous.
3. Recording the same, the Criminal Petition is dismissed as infructuous. As a sequel, miscellaneous applications pending, if any, in this petition, shall stand closed.
