Page No.1 of 6 https://www.mhc.tn.gov.in/judis W.P.No.12688 of 2025 For Petitioner : Mr.I.Kowser Nissar For Respondents 1 to 3 : M/s.P.Aishwarya, Government Advocate O R D E R The petitioner has filed this petition to direct the respondents to handover possession of restrooms/hostels Nos.1, 2 and 3 belonging to the respondents situated in Chengalpet Road, Thirukalukundram, Chengalpet District pursuant to the proceedings dated 13.12.2021 in Na.Ka.No.357 of 2021 of the second respondent with all amenities such as septic tank, power connection water, etc, as sought vide dated 30.09.2024. 2. The case of the petitioner is that the petitioner became the successful bidder in a public auction conducted on 10.12.2021 for the monthly lease of three restrooms/hostels located in a commercial complex in Chengalpet, for a period from 01.04.2027 to 31.03.2025, at a monthly rent of Rs.5,400/-. A confirmation order was issued on 13.12.2025 by the third respondent, and the petitioner deposited a security amount of Rs.1,00,000/-. Despite this, the respondents failed to hand over possession of the restrooms/hostels and did Page No.2 of 6 https://www.mhc.tn.gov.in/judis W.P.No.12688 of 2025 not provide the assured amenities, even though approval had been granted by the Special Officer, Directorate of Town Panchayats. Repeated representations to the authorities yielded no result. As the lease period commenced without delivery of possession and the deposit remains unutilized, the petitioner has come forward with the present writ petition. 3. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the third respondent to consider the petitioner's representation dated 30.09.2024 on merits, in accordance with law and pass appropriate orders within a time frame to be fixed by this Court. 4. Learned Government Advocate appearing for the respondents has no objection for the said order being passed by this Court. 5. Heard the learned counsel on either side and perused the materials available on record. 6. Considering the limited relief sought for by the learned counsel for Page No.3 of 6 https://www.mhc.tn.gov.in/judis W.P.No.12688 of 2025 the petitioner, this Court without going into the merits of the case directs the third respondent to consider the petitioner's representation dated 30.09.2024, after giving due notice to the petitioner, affording an opportunity of personal hearing and considering the documents filed by the petitioner on merits, in accordance with law and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order. 7. This writ petition is disposed of with the aforesaid observation and directions.
