HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 15496 of 2025 Court No. - 34 HON'BLE VIKAS BUDHWAR, J. 1. Heard learned counsel for the parties. 2. It is submitted on behalf of learned counsel for the petitioner that in view of judgment of this Court passed in Writ A No.2829 of 2022 dated 03.08.2023, all the volunteers of Prantiya Rakshak Dal have been held to be entitled to daily wages at par with those volunteers of homeguards and upon an intra-court appeal being preferred by the State being Special Appeal No.633 of 2023, while staying the effect and operation of the judgment. Vide paragraph 9 the Division Bench (Presided over by Hon'ble S.D. Singh, J.) held thus: "9. At present it is provided by way of an interim measure, subject to the State- appellant paying the original petitioners, remuneration at the rate being paid to the U.P. Home Guards from 01.04.2025 onwards such that arrears, if any, may be paid by 30.06.2025, and continuing to pay the volunteers of Prantiya Rakshak Dal at that rate, thereafter, the effect and operation of the impugned order 03.08.2023 shall remain stayed as to other arrears and other claims." 3. It is argued by learned counsel for the petitioner that against the said judgment a Special Leave Petition was preferred by Sanjay Kumar and others but the Supreme Court declined to grant indulgence and only directed for expeditious disposal of pending Special Appeal. It is further contended that the District Young Welfare and State Development Affairs Officer, Prayagraj has issued a circular on 21.08.2025 for compliance of the order of Division Bench subject to the final outcome of the Special Appeal.
