Sundar, CJ) [1] ‘Central Administrative Tribunal, Guwahati Bench’ (‘said Tribunal’ for the sake of brevity and convenience) made a common order dated 30.05.2025 in Original Application No. 042 of 2024 (this Court is informed that 042 was originally assigned No. 00027) and Original Application No. 28 of 2024. There are four applicants in Original Application No. 042 of 2024 and two applicants in Original Application No. 28 of 2024. ‘The common order made by said Tribunal (dated 30.05.2025)’ shall hereinafter be referred to as ‘impugned order’ for the sake of convenience. This court is informed that the impugned order is in favour of all the six applicants i.e., four applicants in Original Application No. 042 of 2024 and two applicants in Original Application No. 28 of 2024, they have accepted the impugned order and given legal quietus to the same. [2] However, State has assailed the impugned order as regards Original Application No. 28 of 2024 in the Gauhati high Court vide W.P. (C) No. 1348 of 2026 arraying the two applicants in Original Application No. 28 of 2024 as two respondents. [3] A Hon’ble Division Bench of the Gauhati high Court in and by an order dated 09.03.2026 dismissed afore-referred writ petition {W.P. (C) No. 1348 of 2026}. [4] As regards captioned WP, i.e., W.P. (C) No. 1030 of 2025, State has chosen to file the same in this Court qua Original Application No. 042 of 2024 arraying the four applicants before said Tribunal as respondents. [5] In the aforesaid scenario, Mr. BR Sharma, learned ‘Central Government Counsel’ (‘CGC’ for the sake of brevity) sought leave of this Court to withdraw the captioned writ petition but made a plea to give liberty to State to approach an appropriate Court/forum if so advised and if so desired. A scanned reproduction of the endorsement made by Mr. BR Sharma, learned CGC in the case file in this regard is as follows: [6] To be noted, as regards four respondents, Ms. G. Pushpa, learned counsel on record is before this Court (physical Court). [7] Afore-referred request of Mr. BR Sharma, learned CGC is acceded to. [8] The sequitur is, captioned WP is disposed of as withdrawn/closed albeit with preservation of rights, contentions and liberty of the State/writ petitioners to approach appropriate Court/forum if so advised and if so desired.
