Hon'ble Ajit Kumar,J. Sri Vishal Tandon, learned counsel for the petitioner submits that some regular Chief Pharmacist has come to take charge of the post of Chief Pharmacist in the district and accordingly, the petitioner's claim to be appointed as In-charge does not survive. Besides above, from the instructions placed before this Court by learned Standing Counsel, I find that petitioner's seniority is at 4463 in the list of pharmacist whereas Sri Yatendra Prasad, Chief Pharmacist, who has now been given the charge, his seniority was 2838 and accordingly he is definitely senior to the petitioner. Since senior most pharmacist has taken over, no cause survives. In above view of the matter, this petition is cosigned to records as infructuous matter.
