HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL REVISION No. - 3402 of 2025 Court No. - 91 HON'BLE ABDUL SHAHID, J. 1. Case called out in the revised list. Learned counsel for the revisionist and learned A.G.A. are present. None has appeared on behalf of opposite party nos. 2 to 5 despite service of notice. 2. Heard learned counsel for the revisionist and the learned A.G.A. for the State. Perused the record. 3. The instant revision has been filed with a prayer to set aside the impugned judgment and order dated 30.4.2025 passed by the learned Special Judge (D.A.A. Act)/Additional Sessions Judge, Room No. 2, Chitrakoot, in Criminal Misc. Case 68 of 2025 (Suresh Singh Vs. State of U.P. & others), under Section 173(4) of B.N.S., 2023, Police Station Bargarh, District Chitrakoot. 4. The basic fact narrated in the application under Section 173(4) of B.N.S., 2023 is the real dispute between revisionist/Suresh Singh and his wife/Urmila/opposite party no. 4. 5. The contention of learned counsel for the revisionist is that there are family property which has already been mutually partitioned and separated between all the brothers of the revisionist. Previously, Urmila/opposite party no. 4, wife of the revisionist agreed to that mutual settlement and partition. But thereafter, she consistently raised pressure upon the revisionist that he should take his due share in the property and the quarrel took place between them. It is further submitted that Urmila/opposite party no. 4 has also filed a case for Versus Counsel for Revisionist(s) : Maneesh Kumar Counsel for Opposite Party(s) : G.A. Suresh Singh .....Revisionist(s) State Of U.P. And 4 Others .....Opposite Party(s) maintenance before the family court. It is lastly submitted that there appears to be either a specific dispute between the husband and wife or the property dispute within the family. 6. The alleged incident, in view of all the facts and circumstances mentioned hereinabove, does not appear to be reasonable, hence the impugned order was passed by the trial court. This Court does not find any illegality, irregularity or jurisdictional error committed by the trial court. This revision is, thus, dismissed. October 15, 2025 M.
