This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.87/2025 registered at Police Station – Outpost-Manora, Police Station-Jashpur, District- Jashpur (C.G.) for the offences punishable under Sections 4, 6, 10 of Chhattisgarh Pashu Parirakshan Adhiniyam, 2004 and Section 11(1)(A), 11(1)(D) of Prevention of Cruelty to Animal Act, 1960. 2. Case of the prosecution, in brief, is that on 05.04.2025 the Police of Outpost Manora through informant that one person is taking 4-5 GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.05.08 18:23:34 +0530 2 buffaloes towards slaughter house at Govindpur (Jharkhand) Via Sarwa Jungle. On the basis of above information, the Police Personnel arrested one Saniya Ram and seized the buffaloes. The memorandum statement of the said Saniya Ram was recorded in which he disclosed that the present applicant is the owner of the said buffaloes. On the basis of said memorandum statement, the present applicant has also arrayed as accused in the Crime No. 87/2025. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He would submit that the applicant is a villager and he is agriculturalist by profession. He would submit that only on the basis of memorandum statement of the co- accused, he has been made accused. He would submit that the applicant is indulged into the sale and purchase of cattle, for which, the applicant is holding license issued by the Collector, District Jashpur. He would submit that the co-accused Saniya Ram has been granted regular bail by the court below. He would submit that on the date of incident, the buffaloes were not being taken towards slaughter house and only on the basis of suspicion, the crime in question has been registered by the Police Chowki, Manora. Therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, considering the fact that buffaloes were not seized from the present applicant and only on the memorandum 3 statement of one Saniya Ram name of the present applicant has been disclosed and the fact that investigation and trial are likely to take time, this Court finds it appropriate to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Ramprasad Yadav, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
